Definition of Terms
The following definitions apply to
terminology used within this Privacy Statement:
Client and Customer-
mean an individual or company who has purchased and/or uses and/or applies to
use one of our products or services.
Consent-
means a voluntary agreement. Consent can be express, implied or provided
through an authorized representative. A client can express consent orally, in
writing or electronically. Express consent is unequivocal and does not require
inference by us. Implied consent may reasonably be inferred from the action or
inaction of the client.
Member and Membership-
mean an individual or company who has purchased one or more of our products or
services. Membership is automatic for purchasers. A Membership Number is
required to consummate the purchase and download of any of our products or to
access the quarterly Critical Paths E-Magazine.
Personal Information-
means information in our records about our identifiable individual customer.
This may include, without limitation, the individual’s name, mailing address,
telephone number, email address, age range, gender, membership number, type of
job or work, purchase records and payment information.
Records-
mean any entries made in our books, systems and databases during the usual and
ordinary course of our business. It includes all documents, correspondence,
emails, email attachments, memoranda, books, plans or any other documentary
material regardless of physical or electronic form or characteristics, and any
copy of these things that are in our possession.
Site, The Website or Our Website-

Third Party-
means any individual or organization other than a member or us.
Use-
means our management of personal information.
Visitor-
means any individual that has accessed our website but has not yet purchased
one of our products or services.

Partners, officers, shareholders, employees, agents and contributors.
You and Your-
mean a member, client, customer or visitor.

ensure immediate handling.
3) If you do not receive
acknowledgment of your inquiry by return email or fax within 24 hours, or your
inquiry has not been satisfactorily addressed, you should then call us
directly at 905-728-0954. We will make every possible effort to resolve your
concerns quickly to your and our mutual benefit.
Your Information is Secure
Our site uses forms in which you
give us contact information [name, address, daytime telephone number, email
address] so you can receive your Membership Number, place orders, make
payment, request information and support, and make product suggestions.
When you order from us using a credit
card, we will collect your credit card number and expiry date in a secure site
solely for the purposes of transacting and confirming payment.
If you contact us for support, we will
keep an internal record of what support was given.
We use your customer information only when
it will be important for us to contact you regarding functionality changes to
our products, our web site, new /changed services, and special offers we think
you'll find valuable.
If you would rather not receive this

to change your preferences.
If we present a co-branded offer with our
partners or affiliates, we will advise you who is collecting the information
and the particular Privacy Statement that applies.
We may, in future, use third-party

your shopping cart and receipts. We use cookies to identify you so you don't
have to login each time you visit our site. They are linked to your Membership
Number, which is associated with the information in your account.
This site also contains links to other
sites for your convenience. We are not responsible for the privacy practices
or the content of such websites. But we would like to know if any of these
companies fail to provide you with adequate service and value or if they
breach their privacy commitments to you. It is NOT our desire to link
our clients with disreputable companies since this will reflect poorly on us.

complaints concerning companies that link to our site.
Updating Your Information
As our customer, you may alter your
customer information or opt-out of receiving communications from us and our
partners at any time. We have the following options for changing and modifying
your customer information:

Email Communications
We use email as our principal
method of communicating with you to confirm your placed orders and to send
information that you have requested.
We provide email links, as on our “Contact
Us” page, to allow you to contact us directly.
We strive to promptly reply to your
messages.
The information you send to us may be
stored and used to improve this site and our products, or it may be reviewed
and discarded.
We will not provide third parties with
information that you send us via email, unless you provide us with your
express consent.
Legal Obligation To Supply Your
Personal Information
We will not share your personal
information with any third party except in cases where:
• We are compelled to do so by legal order
to comply with the laws and statutes of Canada, or
• You have provided us with your
express consent to provide it to a third party.
In rare situations, one of our business
partners may require your personal information. If so, we will seek your
express consent to provide it to them.

If we make material changes to our
information-handling practices or other privacy aspects, we will post those
changes in this Privacy Statement and provide highlights of these changes on
our Home Page in the “What’s New” section, at least 15 days prior to their

Service Provider
We use a payment processing
company to handle your purchases from us that are charged to your account with
a credit card provider. The payment processing company does not retain, share,
store or use your personally identifiable information for any secondary
purposes.
Customer Surveys
From time to time, we will request
information/opinions from our customers via confidential surveys. In certain
circumstances, we may employ a survey service provider company to conduct the
survey from start to finish on our behalf.
If we employ a survey service provider
company, they will devise the survey, forward it to our clients, obtain survey
replies and compile survey results, supporting data and comments. They will
provide us with the completed survey report in a format that does not disclose
your personal information, unless you provide them with your express consent
to identify your information or comments to us.
The survey service provider company will
not disclose your personal information to us or to any third party without
your consent.
Following completion of the survey, the
survey service provider company will erase your personal information from
their records.
Customer participation in these surveys is
completely voluntary; members may choose whether or not to disclose any
information or opinions to us or to the survey service provider company, if we
employ one. Information requested may include contact information, such as
name and address, and demographic information, such as age [in a range],
gender, type of work, type of job, etc.
Survey results will be used to monitor and
improve our website, products and services. These results may be published, by
broad category, on criticalpathbiz.com but we will not publish any of your
personally identifiable information without your express consent.
If you provide written comments within the
Survey, we may publish these with your identity withheld, unless you have
provided us with your express consent to publish your personal information.
If you agree, you can choose one of the
following formats to identify your comments:
a) Shortened first name, type of work,
industry, city and country. Example: “J. Smith, Manager, Financial Services,
New York, USA”, or
b) Shortened last name, type of
work, industry, city and country. Example: “Joanne P. Owner, Food Retail
Store, Miami, USA”, or
c) Full name, type of work,
industry, city and country. Example: “Jane M. Doe, HR Administrator,
Advertising, Toronto, Canada”, or
d) Full name, job title, company
name, city, state/province and country. Example: “Peter D. Cluff, General
Partner, Critical Path Business Solutions, Oshawa, Ontario, Canada”.
Member Referrals
E-Magazine Subscription Gift-
Members may purchase a subscription to our quarterly Critical Paths E-Magazine
as a gift for a friend. The Member will provide the friend’s personal
information to us and the referred friend will automatically become a member
and receive email confirmation from us regarding membership, the E-Magazine
and our website. [Click

We will store the new Member’s personal
information in the same manner as any member’s information and will not
disclose it to anyone without the new Member’s express consent.
In all cases, sales are final and not
subject to a refund. The Member should take this into account when purchasing
a gift subscription for a friend.
Name Referrals-
If a Member wishes to allow us to simply inform a friend about our website, we
will ask the Member to supply us with the friend's name and email address. The
member should use our “Contact Form” for this type of referral. [Click

We will automatically send the friend a
one-time email inviting them to visit our website. We will store this
information for the sole purpose of sending this one-time email and for
tracking any response back to this invitation. In this case, the referred
friend may contact us using the “Contact Form” to request removal of this
information from our database.
Personal Information and
Expired/Cancelled Membership
When you cancel your membership
with us, or it expires, all of your Membership personal information is placed
in "Deactivated" status in our records.
Expiry of your membership will occur 2
years after your latest purchase, unless you have expressly requested that we
retain it for a longer period.
Deactivation does not mean that your
personally identifiable information has been deleted. We will retain and use
your personal information for 2 years after your Membership is canceled or
expired. We may retain it for a longer period if there is an ongoing dispute
or if you request that we retain this information longer.
