Critical Path Business Solutions ®

Products:
The Hands-On Performance Management System
Products, made available via criticalpathbiz.com by Critical Path Business
Solutions, are designed to make it possible to quickly create your own
comprehensive business documents leading to direct measurement and management
of employee performance by you.
Please note, however, that these forms and
instructions are not a substitute for the advice of an attorney. Legal advice
regarding your business is always best sought from competent, independent,
qualified legal experts in your relevant jurisdiction.

Business Solutions make absolutely no warranties regarding the suitability of
using these forms and instructions in your particular company or the success
you might have in implementing and maintaining the Hands-On Performance
Management System in your company.
Membership Conditions:
Membership in criticalpathbiz.com is free
and automatic if you purchase one of the Hands-On Performance Management
System Products or services AND you provide us with valid Registration
information, including your email address.
As a Member of criticalpathbiz.com [a.k.a.
the “Critical Path Team”], you are entitled to certain privileges:
• Free email support while you
complete and install any of the processes contained in Volumes 1, 2 and/or 3,
or the Full Package of all 3 Volumes, of the Hands-On Performance Management
System.
• Free access to the quarterly
Critical Paths E-Magazine, published in a separate area of
criticalpathbiz.com’s web-site, for one year from the date that you become a
member, or 4 issues including the current issue at the time of registration as
a member.
For example, if you become a member
in July, 2006, the current issue is “Summer, 2006”. You will be entitled to
that issue plus “Fall, 2006”, “Winter, 2006/2007” and “Spring, 2007” issues.
If you purchased the Full Package
of Hands-On products, you will receive 8 free issues of the E-Magazine over 2
years.
• Members are given access to the
current and previous E-Magazines using their valid Membership Number.
Non-members [visitors to the website] can only access a Demo of the
E-Magazine.
If you make further purchases of
Hands-On Performance Management System Products or services [see note], we
will automatically extend your eligibility for further free issues of the
E-Magazine beyond your original membership entitlement.
Note: You will
receive free issues of the E-Magazine, if you purchase one or more of the
following products/services:
> One of Volumes 1, 2 or 3 - 4 Free
Issues, or
> The Full Package (3 Volumes) - 8
Free Issues, or
> Our On-Site Consulting Service -
12 Free Issues.
One of the Hands-On Performance Management
System Products is an optional separate subscription to the quarterly Critical
Paths E-Magazine for one year. You will be registered for Membership through
this purchase. When your free issues expire, you may renew your subscription
upon payment of the subscription rate that is published on criticalpathbiz.com
at that time.
We will notify you of new issues of the
E-Magazine related to your membership, pending expiry of your free issues or
your subscription renewal date, provided you register a valid email address
with us. Notification of a change in email address is YOUR
responsibility. Without notification, you must periodically logon to
criticalpathbiz.com and use your valid Membership Number to access your
Membership records (# of issues left) and to see current and prior issues of
the E-Magazine.
Membership Numbers will become “Inactive”
on the Expiry Date of your Membership. Once inactive, you will not be able to
access the E-Magazines or Support sections of this website.
You may renew your Membership by
purchasing another Hands-On product, or by subscribing to the E-Magazine or by
contracting with us for the On-Site Consultation service.
Subject to the “Notes” below, the
Membership Expiry Date is calculated as:
- 12 months from the date of your
original Membership Activation, if you originally purchased one or more of the
Hands-On Volumes (1, 2 or 3), excluding the Full Package, or a One-Year
subscription to the E-Magazine, OR
- 24 months from the date of your
original Membership Activation, if you originally purchased the Full Package
of Hands-On products, OR
- 36 months from the date that you
contracted with us for our On-Site Consultation service, OR
- Your original Membership Expiry
Date PLUS an additional 12 months when you make a subsequent purchase or
purchases of any kind, subject to the Notes below.
Notes:
1. Providing Members with access to free
E-Magazines based on the above purchases (excluding paid E-Magazine
subscriptions) is an Introductory Offer that may NOT be available at the time
of subsequent purchases or your Membership Expiry Date.
2. Free E-Magazines include any
back issues that are on file in the secure site prior to your Membership
Activation Date. In effect, if you become a Member any time after the Fall,
2006 E-Magazine is published, you will have access to more than 4 free issues
of the E-Magazine for each 12 month period of your Membership.
Currency & Payments:
All prices published on
criticalpathbiz.com are stated in Canadian dollars.
All Payments are to be made to Critical
Path Business Solutions in Canadian Dollars.
The purchaser and the financial
institution or credit card provider handling the payment on behalf of the
purchaser are responsible for converting the customer’s currency into Canadian
Dollars at the current rate of exchange agreed to by the customer.
criticalpathbiz.com and Critical Path
Business Solutions are not involved in or responsible for any calculations to
convert purchase amounts into Canadian Dollars.
Payments made to Critical Path Business
Solutions, via criticalpathbiz.com, are managed by ECI (Electronic Commerce
International), a registered I.C. Agent for Dynamic Payment Solutions, HSBC
Bank.
Taxes:
The Ministry of Finance- Tax Advisory
Services Branch of the Government of The Province of Ontario has provided an
interpretation that Retail Sales Tax (PST) does not apply to Critical Path
Business Solutions' products & services.
The Canada Customs and Revenue Agency,
acting on behalf of the Federal Government of Canada has provided
an interpretation that Goods & Services Tax (GST) applies at 7 % (to be
reduced to 6 % effective July 1, 2006) to Critical Path Business Solutions
Handbooks and Templates (i.e. the Hands-On Performance Management System) and
to the On-Site Consulting Service, based on the Ontario location of the
services provided. The C.C.R.A. has also interpreted that GST does not apply
to the Critical Paths E-Magazine subscription.
Pricing:
We are constantly researching industry and
competitive pricing for products that are comparable to ours to ensure that
you get the best value for your money.
But you may feel that the price on one or
more of our products requires adjustment.
We welcome any feedback that you are
willing to provide us on our pricing. Please send us an email to
Comments@criticalpathbiz.com and include the name of our product, the
reason(s) you believe our pricing should be adjusted and the name and pricing
of products to which you are comparing ours. Competitor website information
would also be helpful.
We’ll do everything in our power to make
the “Hands-On” experience a great value for you.
Advice and Referrals Policy:
We cannot and will not provide you with
any advice of a legal, taxation, insurance, investment or financial nature.
To mitigate possible risk to Critical Path
Business Solutions and its general partners, we will not refer our clients
